After a grueling 13 hours in the courtroom, Judge Debra Nelson adjourned for the day and called for court to start at 8:00 a.m. EST on Wednesday. The court had heard from both defense and prosecution in an aside which lasted more than six hours with hearings on whether or not to allow the crime reconstruction animation and text messages and pictures from Trayvon’s phone to be admitted as evidence in the trial. Judge Nelson stated that she would make her decision on Wednesday morning.

Judge Nelson did not appear to want to admit the text messages and pictures as there is no way to prove that Trayvon actually sent them. Don West countered that if he had more time he could track down who they were sent to and prove that it was in fact Trayvon who sent them. In my own opinion, I don’t think he can. There is no way to know for sure whether or not the owner of the phone or other device actually would send the text and images. Unless they were being screen recorded there would really be no way to prove it. I don’t see that evidence as being admitted by the Judge.

Don West and Mark O’Mara seemed a little frustrated with Judge Nelson and appeared to say they felt rushed. This has been the case for most of this trial. It seems like the defense are not ready to do what they were hired to do and that is to defend their client. While O’Mara seems to have at least somewhat respectful with most of the witness’, the same cannot be said about West who appears, in my opinion, to be a lot more brash when dealing with witness’ not on the defense team.

At one point Don West accused the State of misleading the defense and delaying the process to which State prosecutor, John Guy, asked for an apology.

Judge Debra Nelson said, “I’m not getting into this.”
Mark O’Mara pushed his luck and told the judge that due to the long day and early start on Wednesday, that he had no time to prepare his witness’.

Judge Nelson stood up and walked out of the courtroom.

Late start times. Long waits in rooms. I do not think this jury will have a ton of patience for this defense much longer and neither will the judge.

I have not changed my opinion on guilt or innocence. For me it does not matter about the size of the bullet hole, the scratches on George Zimmerman’s head, the way the evidence was collected or kept. What matters for me is that George Zimmerman made a deadly choice on that night and that was to get out of his vehicle with his gun ready to shoot. For me that was malice and ill will. The call and the language used says that as well.

George Zimmerman made up the story he did because he had to. Just like any child who gets caught for doing something they should not have been doing, he lied. Witness Selma Mora said she saw George Zimmerman on top of Trayvon. She says at that time Trayvon was not moving and she called out to George several times but he did not answer. She says he stood up and paced back and forth three times while holding his head and having his right hand in his pocket. He was thinking then which is why he never responded when being called. He knew he was in trouble and had to think of something quick. He is not a very good story teller as he continually changes things.

Now the defense can argue that it’s because our memory doesn’t always work properly but throw this in the mix. George claims to have ADHD or Attention Deficit Hyperactive Disorder and takes medication for that. It so happens my oldest child who is around the same age as Zimmerman, also has ADHD and in the past had taken the medication. One of the things I noticed with my son is that his memory was much better than mine and it was due to the medications. No one has explained how ADHD works or how it may be part of this case so I will do another blog explaining it.

In the mean time, I am anxious to see what will happen tomorrow and although I am trying very hard to get up at 5 in the morning to watch the case, I am having a little trouble. lol I will catch up though and share my view. Thanks very much and remember this is about justice for a young man named Trayvon Martin, son of Sybrina Fulton and Tracey Martin.
